Terms of Service.

Welcome to Airelm. These Terms of Service (“Terms”) apply to your use of airelm.com and any purchase you make from Airelm, LLC (“Airelm,” “we,” “us”). By using our site or placing an order, you agree to these Terms, our Privacy Policy, our Shipping & Returns policy and our Candle Safety guidelines.

1. Using our site

You must be at least 18 years old, or have the permission of a parent or guardian, to place an order. You agree to give accurate information when you check out or create an account, and you’re responsible for keeping your account login secure. You agree not to misuse our site, including by interfering with its operation, attempting unauthorized access, or using it for any unlawful purpose.

2. Our products

Our candles and wax melts are hand-poured in small batches, so color, surface finish, wax appearance, wood wick crackle and fragrance strength may vary slightly from piece to piece and from the photos on our site. Product images are for illustration, and screen colors vary. Scent notes describe the overall character of a fragrance and are not a list of ingredients.

Candles and wax melts involve open flame and hot wax. You are responsible for using our products safely, following our Candle Safety guidelines and all warning labels. If you have fragrance sensitivities, allergies or respiratory conditions, please use caution and stop use if you experience discomfort.

3. Pricing and availability

All prices are in U.S. dollars. Prices, products and availability can change at any time without notice. Seasonal and limited-edition scents are available only while they last. We work hard to keep our site accurate, but errors can happen. If a product is listed at the wrong price or with incorrect information, we may cancel or refuse any order for it, even after the order has been placed, and we’ll refund any payment you made.

4. Orders and payment

Your order is an offer to buy. We may accept or decline any order, limit quantities, or cancel an order for reasons including suspected fraud, unauthorized or reseller purchases, or product availability. If we cancel an order after payment, we’ll refund you in full. You agree that the payment information you provide is valid and that you’re authorized to use it. Applicable sales tax is calculated at checkout.

5. Shipping, title and risk of loss

Orders are shipped as described in our Shipping & Returns policy. Title and risk of loss pass to you when we hand your order to the carrier. We’ll still help with damaged-in-transit claims as described in that policy.

6. Returns and refunds

Returns, refunds and damage claims are handled under our Shipping & Returns policy, which is part of these Terms.

7. Promotions and the Airelm List

Discount codes, members-only offers and early access are subject to the terms stated with each offer. Unless stated otherwise, offers can’t be combined, have no cash value, can’t be applied to past orders, and may be changed or ended at any time. We may cancel orders that use codes in a way that doesn’t follow their terms.

8. Intellectual property

Everything on our site, including the Airelm name and logo, product names, text, photos, graphics and design, belongs to Airelm, LLC or its licensors and is protected by law. You may not copy, reproduce or use it for commercial purposes without our written permission.

9. Reviews and content you share

If you send us reviews, photos, comments or other content, you give us permission to use, display and share that content in connection with our business, without payment to you. You confirm that your content is truthful, belongs to you, and doesn’t violate anyone else’s rights. We may remove any content at our discretion.

10. Third-party links and services

Our site may link to or use third-party services, such as payment processors and shipping carriers. We aren’t responsible for their content, policies or practices.

11. Disclaimer of warranties

Except as stated in our Shipping & Returns policy, our site and products are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t guarantee that our site will be uninterrupted or error-free.

12. Limitation of liability

To the fullest extent allowed by law, Airelm and its owners, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any property damage or personal injury resulting from misuse of our products or failure to follow our safety guidelines and warning labels. Our total liability for any claim related to our site or products will not exceed the amount you paid for the product that gave rise to the claim. Some states don’t allow certain limitations, so some of these may not apply to you.

13. Indemnification

You agree to defend, indemnify and hold harmless Airelm and its owners, employees and partners from any claims, damages, losses and expenses, including reasonable attorneys’ fees, arising from your misuse of our products or site, or your violation of these Terms or any law.

14. Disputes and governing law

If you have a concern, please contact us first at haley@airelm.com. Most issues can be resolved quickly this way, and you agree to try to resolve any dispute informally for at least 30 days before starting a formal proceeding. These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any legal action will be brought in the state or federal courts located in Texas, and you consent to their jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted, and the “Last updated” date above will change. Orders are governed by the Terms in place when the order was placed.

16. General

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms, together with the policies linked above, are the entire agreement between you and Airelm, LLC about your use of our site and purchases.
